Process Serving

Process serving refers to the legal procedure of delivering legal documents to individuals or parties involved in a legal case. The documents being served can include:

  • statement of claims,

  • summonses,

  • complaints,

  • subpoenas,

  • court orders, or

  • other legal notifications.

The purpose of process serving is to inform the recipient about their involvement in a legal matter and provide them with the necessary information or instructions.

Process serving is an essential part of the due process and ensures that individuals are properly notified of legal actions being taken against them. It allows them to exercise their rights, present their defense, or comply with court orders. Process serving is typically carried out by a professional process server or a designated individual who is not directly involved in the case.

The process server physically delivers the legal documents to the intended recipient. This can be done by:

  1. personally handing the documents to the individual,

  2. leaving them with a responsible adult at their residence or workplace, or

  3. using certified mail or other approved methods of delivery.

If the recipient is avoiding service or cannot be located, the process server may employ additional tactics within the boundaries of the law to ensure proper service.
